1. Agreement to Terms
These Terms and Conditions govern all inspections, proposals, contracts, and services provided by Rhino Garage Floors ("Company," "we," "us"). By scheduling an inspection, accepting a proposal, or engaging our services, the customer ("Client," "you") agrees to be bound by these Terms.
2. Services
Rhino Garage Floors provides garage floor coating services, including diamond grinding, crack repair, multi-coat epoxy/polyaspartic systems, flake broadcast, top coat application, and related add-ons (such as cove base and control joint filler), as specified in the Client's signed proposal.
3. Proposals and Pricing
All pricing is provided in writing via a proposal specific to the Client's project. Prices are based on square footage, selected service tier, and any add-ons chosen. Proposals are valid for a limited time as noted and may change if project scope, surface conditions, or square footage differ from what was assessed.
4. Payment Terms
Clients may choose to pay a 30% deposit at signing with the balance due upon substantial completion of the work, or pay in full at signing. Accepted payment methods will be provided at contract signing. Work will not begin until the deposit or full payment (as applicable) has been received.
5. Scheduling and Access
Installation dates are scheduled in advance and are subject to weather, material availability, and surface conditions. The Client agrees to provide clear access to the garage area, remove personal belongings and vehicles, and ensure the space is ready by the agreed start date. Delays caused by lack of access may result in rescheduling.
6. Cancellation Policy
Clients may cancel a signed contract within three (3) business days of signing without penalty, in accordance with applicable law. Cancellations made after this three-day window may be subject to a late cancellation fee of 15% of the total contract amount to cover materials ordered and scheduling commitments.
7. Warranties
Workmanship warranties vary by service tier (1-year, 3-year, or 5-year, as specified in the Client's proposal) and cover defects in installation. All coating systems also carry the manufacturer's lifetime material warranty. Warranties do not cover damage from misuse, chemical exposure not disclosed prior to installation, or modifications made by parties other than Rhino Garage Floors.
8. Site Conditions and Pre-Existing Damage
Rhino Garage Floors is not responsible for pre-existing cracks, moisture issues, structural damage, or settling not identified in the original scope of work. Additional repairs discovered during the installation process may result in a change order, which will be communicated to the Client before proceeding.
9. Limitation of Liability
To the fullest extent permitted by law, Rhino Garage Floors' liability for any claim arising from its services shall not exceed the total amount paid by the Client under the applicable contract. Rhino Garage Floors is not liable for indirect, incidental, or consequential damages.
10. Photography and Marketing
Rhino Garage Floors may photograph completed projects for use in marketing materials, including advertisements and social media, unless the Client requests otherwise in writing prior to project completion.
11. Governing Law
These Terms and any resulting contract are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts of Massachusetts.
